Lightway Psychic & Energy Fair Terms & Conditions

LightWay Psychic & Energy Fair offers vendors the fantastic opportunity to showcase their goods and services in a highly curated market. From aura photography to Zyto scans, LightWay Fair seeks readers, practitioners, healers, jewelry makers and others to share their unique products and services with the LightWay community.

This LightWay Psychic & Energy Fair will be held Saturday, March 31, 2018 at SPIRIT located at 242 51st Street in Pittsburgh, PA.

LightWay Psychic & Energy Terms & Conditions

The terms and conditions here represent a legal binding agreement between Anne McGough, dba LightWay Psychic & Energy Fair (Sponsor) and the Exhibitor. Exhibitor understands that failure to pay the invoice within fifteen (15) day of receipt will result in forfeiture of their booth space. The Sponsor is not obligated to provide reminders. Exhibitor is not entitled to any good or services unless or until the Exhibitor has agreed to these Terms and Conditions and has paid, in full, the Sponsor’s invoice.

The sponsor reserves the exclusive right and discretion to determine the eligibility of all Exhibitors, products and services offered at this event.

Exhibitor – Purchaser of fully paid exhibit space for product(s) or service(s).

Event – Fair, show, expo


INDEMNITY:

Neither the Sponsor, nor any of its partners, officers, agents, employees and other representatives shall be held accountable for, and the same are hereby released from, accountability or liability for any damages, loss, harm or injury to the person or any property of the Exhibitor or any of its agents, employees or other representatives, resulting from theft, fire, water, accident, acts of god or any other case.

Exhibitor hereby agrees to indemnify, defend, protect and hold harmless the Sponsor and the Venue owner against all claims, demand, suits, liabilities, damages, costs, loss, attorney fees, and expenses of whatever kind or nature which might form or arise out of any action or failure to act of Exhibitor or any of its officers, agents, employees, invitees or other representatives.

Arbitration:

No verbal agreements shall be recognized by the Sponsor. All disagreements will be arbitrated by the Sponsor and the Sponsor’s decisions shall be final.

Eligibility:

The Sponsor reserves the right to determine the eligibility of any Exhibitor, or Exhibitors product(s) and/or service(s). The Sponsor reserves the right to make decision regarding the Event layout, space assignments, advertisement(s) as the Sponsor deems appropriate.

Guarantee:

The Sponsor gives no expressed or implied guarantee or warranty and will not provide a refund for weather conditions, public attendance, fire, water, accident, acts of god or any other case.

Floor Plan:

Sponsor reserves the right to change the floor plan at any time.  Space will be assigned to Exhibitors on a first paid basis.

Space Set-up & Tear-down:

Exhibitors may begin setting up their space at 8am the day of the event. All Exhibitor space(s) must be set up for business no later than 20 minutes prior to the published start time of the Event.

Exhibitors are not permitted to begin packing up or breaking down their space prior to the published end of the Event. All spaces must be completely broken down and restored to their original condition within two (2) hours of the published end time for the Event.

Any/all property belonging to the Sponsor or Venue must be returned, in good condition, to the Sponsor or Venue within two (2) hours of the published end time for the Event.

Space Sharing/Subletting:

The subletting or sharing of Exhibitor space is not permitted. All personnel staffing a given exhibition space must work for or represent the same legal business entity, company, organization, association or person d.b.a.

Signage:

Professional looking signage is required and is the responsibility of the Exhibitor. Signage identifying the Exhibitor, their product(s) or service(s) to the public is the sole responsibility of the Exhibitor. The Sponsor will provide visible space numbering.

No signage is permitted to be affixed to the walls, doors, floors, ceilings or, venue provided tables, chairs, platforms with any type of penetrating materials (screws, nails, hooks). If damages occur, the offending Exhibitor agrees to pay all expenses related to the repair or replacement of damaged property.

Exhibit Space Acceptable Use:

The Exhibitor is only permitted to provide/promote product(s) and/or service(s) that have been approved by the Sponsor. The Sponsor reserves the right to reject any product(s) and/or service(s) that is believed to be incongruent with the policies, intentions and purpose of the Event.

Exhibitor Samples/Giveaways/Promotions:

Exhibitor my only distribute literature, brochures, samples, raffles, giveaways, etc. from their assigned exhibit space. Exhibitors may only use electronic or passive diffusers for their products (NO OPEN FLAMES) if neighboring exhibitors or patrons do not mind. If the Sponsor receives any complaints regarding the sound or smell, the Exhibitor agrees to immediately cease use of the offending product.

Space Sharing/Subletting:

The subletting or sharing of Exhibitor space is not permitted. All personnel staffing a given exhibition space must work for or represent the same legal business entity, company, organization, association or person d.b.a.

Health & Safety:

  • NO OPEN FLAMES (burning incense or sage).
  • No animals, except for service animals, are permitted in the Venue.
  • Exhibitors are not permitted to smoke inside the Venue or within 25 feet of Venue entrances.
  • Exhibitors may not block electrical panels or outlets, or cover them with any materials at any time.
  • Exhibitors may not occupy or place items outside of their designated square space that is directly adjacent to any/all exits, doorways, stairs that are in use during the Event.

Electricity:

Electricity is available on a limited basis. Exhibitor must indicate the need for access to an outlet at the time of application. Outlets will be assigned by the Sponsor on a first paid, first assigned, basis. Exhibitor is responsible for supplying any required 100v 2 amp UL certified power strip or extension cords.

Exhibitor must NOT unplug or disturb any electrical cords provided the Venue or Sponsor.

Security:

Each Exhibitor, participant and agents is solely responsible for their personal safety and for securing their belongings, space and valuables.

Food & Drink:

Exhibitors are not permitted to sell food or beverages. Exhibitors are permitted to offer food or drink samples as long as the samples are provided in disposable, 1 oz. or smaller portion cups. Exhibitor offering samples of food or drink must also provide and maintain appropriate trash receptacle at their space.

There will be food and drinks available for purchase from the bar or restaurant of the Venue. 

Lodging, Transportation & Storage:

All lodging, travel and storage needs are the sole responsibility of the Exhibitor.

Exhibitors and their personnel will be permitted to park in the Venue’s parking lot for set up between 8 am-10 am and between 7pm-9pm to space break down on the day of the event.

Exhibitors and there personnel will be directed to another parking area between the hours of 10am-7pm the day of the event

Insurance:

Each exhibitor must provide a compliant Certificate of Insurance naming the Sponsor and Venue as additional insureds, one (1) week prior to the Event.

Patron Payments & Fees:

Each Exhibitor is solely responsible for their method of collecting payment(s) for any service(s) or product(s) provided at the Event. Each Exhibitor is solely responsible for compliance with local, state, and national tax entities. Exhibitors must ensure they have enough cash on hand to provide their patrons with change.

Each Exhibitor is responsible for obtaining and maintaining any wi-fi or data connections for any payment processing needs during the Event.

Exhibitor Support Personnel & Staffing:

Exhibitor must ensure that every member of their support personnel and staff are familiar with and agree to the Terms & Conditions of this Event & Venue.

Any children under the age of 13 who accompany the Exhibitor, their staff or support personnel, must be under the constant supervision of an adult or babysitter, authorized or provided by the Exhibitor, their staff or personnel.


PAYMENTS & CANCELLATIONS:

Payments:

In exchange for Sponsor provided terms, the Exhibitor agrees to remit payment, in full to the Sponsor within fifteen (15) days of receipt of an invoice. Payment includes a $5 non-refundable processing fee.

Payments can be made through PayPal with a major credit or debit card or by check. Exhibitor may also pay by check. Any check(s) returned to the Sponsor, will incur a $35 fee as well as any fees associated with the collection of the debt and be paid for by the Exhibitor.

Cancellations:

Cancellations made twenty (20) days prior to the date of the Event will result in a full refund, minus the non-refundable $5 processing fee. Any cancellations less than twenty (20) days before the date of the Event will forfeit 50% of all monies paid including the non-refundable $5 processing fee as well as the reserved Exhibitor space(s).

Sponsor reserves the right to reassign Exhibitor space to another Exhibitor. Sponsor will return applicable monies by the Exhibitor’s original method of payment no later than ten (10) days after the date of the Event.

    4. I will be responsible if there are any claims or refunds to the client and/or patron who I provide service(s) or product(s) to at the 2018 LightWay Psychic & Energy Fair.
    5. I will not hold LightWay Psychic & Energy Fair, Sponsor, Venue owner, agents, employees, officers or representatives legally responsible for any loss, theft, or injury.
